Person Conducting a Business or Undertaking ("PCBU")

In Australian WHS (Work Health and Safety) legislation, a Person Conducting a Business or Undertaking (PCBU) refers to an individual or organisation that operates a business or undertaking, whether for profit or not. This definition is broad and includes companies, sole traders, partnerships, franchises, government agencies, and non-profit organisations.

A PCBU has a primary duty of care under WHS laws to ensure, as far as is reasonably practicable, the health and safety of workers and others impacted by its operations. This duty extends to:

  • Providing safe work environments
  • Maintaining safe plant, structures, and systems of work
  • Ensuring safe use, handling, and storage of equipment, structures, and substances
  • Offering adequate training, information, and supervision

In essence, a PCBU is accountable for the overall safety of its workers and any other individuals affected by its work activities.
