Under the Product Lifecycle Responsibility Act 2025 (NSW), a brand owner is defined as a person or entity who:

  • Manufactures a product under their own brand; or
  • Imports a product for supply within NSW; or
  • Supplies a product under a brand they own or control; or
  • Has effective control over the design, production, or supply of the product.

This means that manufacturers, importers, private label distributors, and sometimes retailers may all be considered brand owners depending on their level of control over the product supplied.
